An interesting ET decision - unlawful redundancy

In this case, the principle of proportionality was not observed when, in a redundancy selection exercise which consisted of a male solicitor and a female solicitor on maternity leave, the employer gave the female a notional maximum score not based on her actual performance for one of the selection criterion. There were alternatives that would have protected the woman's position without giving her an unfair advantage over her male colleague, who suffered unlawful sex discrimination.
