Shared Parental Leave technical guidance for employers issued by BIS

A technical guide to Shared Parental Leave has been published by the Government to help employers understand their obligations around the new legislation.

Shared Parental Leave and Pay will be available for eligible employees whose baby is due on or after 5 April 2015, or who have a child placed with them for adoption on or after that date.

But one recent survey found that most employers had not yet reviewed or amended their policies in light of the new legislation.

The 56-page 'Employers' Technical Guide to Shared Parental Leave and Pay' does more than only describe how Shared Parental Leave will work.

It tackles some of the more difficult aspects of the scheme, including what to do if employees change their leave plans, or how the new measure might fit in with existing occupational maternity schemes.

Practical advice

Practical advice covers knowing whether your employee qualifies for Shared Parental Leave and Pay, what information you can ask for, working out how much leave and pay employees are entitled to, and about dealing with arrangements for 'booking' leave and pay.

The guide lays out employers' responsibilities in performing checks and their liability in case an employee commits a fraud by claiming too much leave or pay.

It also helps employers navigate situations in which employees have more than one job, and how to calculate available leave between multiple employers.

In the difficult situation that the mother, father or baby dies before or after maternity leave and pay is curtailed for Shared Parental Leave, the guide has detailed advice about employers' obligations.

The guide recognises that most employers won't encounter many of the problems discussed, but advises them to consider them when developing and implementing their policies.
